Privacy policy
At DesignUnik, we take the protection of your personal information seriously. This policy explains what we collect, why, and how we protect it, in accordance with Québec’s Law 25 on the protection of personal information.
Information we collect
- Contact details: name, email, phone number and, where applicable, your organization’s name.
- Project details: sport, items, quantities, colours, logos and files you send us.
- Order information: delivery address, order history and, for team stores, the names, numbers and sizes submitted by each buyer.
- Technical data: anonymous browsing information used to improve our site.
How we use it
- Communicate with you and prepare your quote.
- Design, produce and deliver your order.
- Provide after-sales service and keep you informed about your project.
We only use your information as needed for these purposes and never sell it to third parties. Our service providers (payment, shipping, hosting, messaging) only access what is strictly necessary and must protect your data. You may at any time access, correct or have your information deleted by writing to us.
Terms of sale
These terms apply to all DesignUnik products and services — sublimated team uniforms, corporate apparel, promotional products (tents, banners, flags, accessories), online team stores, reprints and design services — regardless of how you order (website, online store, phone, email or in person). Placing an order means you accept these terms.
1. Quotes and pricing
- Quotes are free and non-binding. They remain valid for 30 days unless stated otherwise in writing.
- Prices are in Canadian dollars; taxes and shipping are extra unless stated otherwise.
- An obvious pricing error (typo, display bug) does not bind DesignUnik: we will offer the corrected price or a free cancellation.
- Any change to the project after the quote (quantities, items, design complexity) may change the price.
2. Deposit and payment
- Depending on the project, a deposit or payment may be required before design or production begins. The amount and terms are always clearly confirmed before we start.
- Once design work has started, the deposit is non-refundable: it covers our designers’ actual time.
- The balance is payable as agreed at the time of ordering. DesignUnik may pause production or delivery on any order with an outstanding balance.
- Design fees billed separately remain earned even if the project does not go to production.
3. Design and approval — your responsibility
Before any production, we present a render of your design and adjust it with you. The approved design is the final and exclusive reference for production.
- It is your responsibility to check everything before approving: spelling of names, numbers, logos, sponsors, colours, placement and sizes.
- Any error present on an approved design and reproduced in production is the client’s responsibility (including spelling mistakes and wrong numbers).
- Any change requested after approval may involve fees and new timelines.
- Player rosters (names, numbers, sizes) are produced exactly as submitted by the client or by each buyer.
4. Sizing
- Une charte des grandeurs est disponible pour chaque type de vêtement. Le choix de la taille relève du client (ou de chaque acheteur en boutique d’équipe).
- A manufacturing variance of up to half an inch (½ ») is normal in the industry and is not a defect.
- Custom products cannot be exchanged or refunded over sizing.
5. Colours and materials
- On-screen colours (phone, computer, 3D render) may differ from the final product: this is not a defect.
- Slight shade variations between production batches, fabric types or printing techniques are normal.
- Exact colour matching (e.g. Pantone) is not guaranteed without prior written agreement.
- DesignUnik may substitute an equivalent base garment or material of equal or better quality if suppliers run out.
Team stores and online orders
- Each team store has a defined ordering window; production starts after it closes or as agreed with the organization.
- Each buyer is responsible for their own selections: size, name, number and options entered at checkout.
- A store order can be cancelled and refunded as long as production has not started; once launched, it is final.
- Items ordered after a window closes may be produced in the next cycle.
- The organization (team, league, business) is responsible for the accuracy of information shared with its members (dates, products, sizes).
Delivery and receiving
Timelines
- Communicated timelines are good-faith estimates, not contractual commitments. You can follow your project’s progress in your client portal.
- DesignUnik is not responsible for delays caused by carriers, customs, suppliers, incomplete client information or force majeure.
- A delivery delay does not entitle you to compensation or to cancel an order already in production, subject to applicable law.
Shipping and receiving
- The client is responsible for providing an accurate, complete address. Reshipping fees due to a wrong address are the client’s responsibility.
- A package confirmed delivered by the carrier is deemed delivered.
- Inspect your order upon receipt. Any missing, damaged or non-conforming item must be reported to us in writing within 72 hours of delivery, with photos, for priority handling.
Warranties, returns and refunds
The bottom line: our products are made to order, in your image. Once the design is approved and production starts, every custom product sale is final — that’s exactly why the approval step exists.
- No returns, exchanges or refunds on a custom product that matches the approved design (taste, change of mind, approved error, size choice).
- In the event of a manufacturing defect or non-conformity with the approved design, DesignUnik will make it right through rework, replacement or credit, at its discretion, after inspection (photos or returned item).
- Normal wear, improper care (high-heat dryer, bleach, ironing directly on the print), product alterations or abnormal use are not covered.
- No claim is processed on a washed or worn product, except for a proven manufacturing defect.
- Free items, samples and prototypes are provided « as is ».
Legal warranties: these terms apply subject to the warranties provided by Québec’s Consumer Protection Act and the Civil Code of Québec, from which they do not derogate for consumer clients.
Intellectual property and content
- You warrant that you hold all rights to the logos, trademarks, images and text you provide, and you hold us harmless from any third-party claim about them.
- Mockups, renders, design files and production files created by DesignUnik remain DesignUnik’s property. They are not transferred or usable elsewhere without written agreement.
- DesignUnik reserves the right to refuse any illegal, hateful, defamatory or infringing content.
- Showcase rights: DesignUnik may photograph and feature completed products in its portfolio, on its website and social media. If you prefer your project stay confidential, let us know in writing before production.
- A discreet DesignUnik signature may appear on products, per industry practice.
Liability, cancellation and miscellaneous
Cancellation
- By the client: before design work starts → refund of amounts paid, minus costs incurred; after design work starts → the deposit and design fees remain earned; after approval or production launch → the order can no longer be cancelled.
- By DesignUnik: we may refuse or cancel an order (obvious error, unavailability, unacceptable content, overdue account); amounts paid for work not performed are then refunded.
Limitation of liability
- DesignUnik’s total liability for an order is limited to the amount actually paid for that order.
- DesignUnik is not liable for indirect damages: missed events or tournaments, lost revenue, sponsorships or opportunities, reputational harm, etc.
- These limitations apply to the fullest extent permitted by law and do not restrict the mandatory rights of Québec consumers.
Force majeure
DesignUnik is not responsible for delays or non-performance caused by events beyond its reasonable control: pandemic, strike, fire, major outage, supply shortage, carrier or supplier failure, natural disaster, etc.
Miscellaneous
- These terms are governed by the laws of Québec. Any dispute falls under the courts of the judicial district of Trois-Rivières, subject to mandatory consumer rules.
- If any clause is found invalid, the others remain in full force.
- DesignUnik may update these policies; the version published on this page prevails.
- A one-time accommodation (e.g. accepting a late claim) does not waive these terms.
